Building Defects: How do You Prove Systemic Defects?

Introduction

It is an unfortunate reality that many strata apartment buildings contain defects.  Many of those defects are widespread or systemic defects that affect most or all of the lots.  But how far does an owners corporation have to go to prove the existence of systemic defects?  Does the owners corporation have to organise for its experts to inspect each and every lot to prove that those systemic defects exist in each lot?  A recent Supreme Court case provides the answer to that question.

The Case

There is a strata complex containing 45 townhouses in Tweek Heads South.  The complex was built in about 2018 and 2019.  There are defects in the complex.

In 2021, the owners corporation of the complex sued the builder for damages to (among other things) cover the cost to rectify defects throughout the complex.  In the case, the owners corporation claimed that several defects were systemic and present in numerous townhouses.  One of those defects related to waterproofing defects at the outer edge of balconies above garage doors of many townhouses.

The parties’ experts agreed that the beam which spans the outer edge of the balconies on two of the townhouses suffered moisture damage due to the same waterproofing defect on the balconies of those townhouses.  However, the owners corporation’s expert did not inspect any of the other townhouses or carry out any investigations to prove that those defects existed in them.  The builder denied that those same defects existed in the other townhouses and claimed that the owners corporation had not proved its case in that regard.

Proving the Existence of Systemic Defects

The Court agreed with the builder and concluded that the owners corporation had not proven, on the balance of probabilities, that the waterproofing defects and moisture damage to the beams on the outer edge of the balconies existed in any of the other townhouses.  In other words, the Court concluded that the owners corporation had not proven that those defects were systemic.

The Court relied heavily on an earlier decision in The Owners – Strata Plan No. 62930 v Kell & Rigby Holdings Pty Ltd [2010] NSWSC 612.  In that case, the owners corporation of a block of 14 units argued that no water stops had been installed by the builder in the bathrooms of all 14 units.  The owners corporation’s expert evidence only proved that there were no water stops in the bathrooms of three units.  But the owners corporation claimed that the lack of water stops was a systemic defect present in all of the bathrooms.

The Court held that it could not be inferred from the evidence that established that there were no water stops in three bathrooms that waterproofing work was incorrectly performed in other units and observed that the fact that the waterproofing contractor defectively performed work in a small number of units did not warrant a conclusion that it did so everywhere else.  Importantly, the Court concluded that the burden of proof lay on the owners corporation and that it had chosen to carry out limited destructive testing in three bathrooms only when there was no reason why it could not had done so in all of the units.

In the case involving the townhouse complex in Tweed Head South, the Supreme Court followed the reasoning in Kell & Rigby and concluded that there was insufficient evidence available to support the inference that the balcony waterproofing defect in two townhouses provided a basis for finding that the same defect existed in all 26 townhouses which have front first floor balconies.

Importantly, the Court held that it could not rely on the opinion of the owners corporation’s expert that the defect was systemic due to similar construction details being present in all townhouses because it was not known whether the waterproofing defects that had been identified in two of the townhouses were caused by faulty design or shoddy workmanship.  For all of these reasons, the Court rejected the owners corporation’s claim that the defect on the outer edge of the balconies was a systemic one that affected all such balconies and instead only accepted that the defect existed in two of the balconies that had actually been inspected and tested by the owners corporation’s experts.

Conclusion

The case provides a salutary lesson for owners corporations who wish to pursue a claim against a builder, developer or subcontractor for systemic defects.  Typically, the owners corporation will need to go the extra mile and pay its expert to inspect more than just a handful of lots to ensure that adequate testing and investigations are undertaken to enable the expert to form an opinion that will allow the owners corporation to prove, on the balance of probabilities, that the defect in question is widespread and systemic.  In some cases, this will require the expert to inspect and undertake testing and investigations in all of the lots, which in a large strata building, can be expensive.  But that is the unfortunate price an owners corporation must sometimes pay in order to succeed in a claim with respect to systemic defects.

Does the Joy of Keeping a Pet in Strata come at a Cost?

Keeping a pet in some strata schemes can be costly when schemes charge an additional fee or bond for the joy of having a pet!

The good news is that the NSW Government as part of the reform has labelled these fees and bonds as being costly, unreasonable, and unnecessary as lot owners already pay levies.

The reform is part of phase one of the NSW Government’s review to ensure we have a more transparent and fairer strata system.

Pushy Telcos and Owners Corporations

Owners corporations are increasingly encountering aggressive behaviour by some telecommunications providers who say they are acting under powers granted to them pursuant to the Telecommunications Act.

Preserving the owners corporation’s rights and negotiating position can come down to whether the owners corporation responds in a timely fashion, and in accordance with the relevant legislation.

Failure to do these things may mean the owners corporation is stuck with a proposal to install infrastructure and technology which the owners do not want.

It is important that you understand the steps which your owners corporation needs to take in dealing with such telecommunications providers.


The Rise of “Low Impact” Telecommunications Infrastructure

Once upon a time, the only occasion on which an owners corporation would hear from a telecommunications provider was if that telecommunications provider wished to install a mobile telephone tower on top of the building comprising the strata scheme.

In most instances this would lead to negotiations between the owners corporation and the relevant telecommunications provider as to the nature of the leasing arrangement which would be put in place to enable that mobile telephone tower to be erected and maintained and almost always the owners corporation would receive rental income as a result of allowing such installation to take place.

Under the Telecommunications Code of Practice 2021, telecommunications providers can give notices to an owners corporation in relation to their intention to use owners corporation’s property for various purposes.  Typically, these notices include:

  • The Inspection Notice – this notice provides the owners corporation with notice of the telecommunications provider’s intention to enter the strata scheme carry out an inspection of the building or buildings comprising the strata scheme to enable the telecommunications provider to consider whether it wishes to proceed with any further proposals; and/or
  • The Installation Notice – typically, a notice of this kind provides the owners corporation with written notice of the telecommunication provider’s intention to install certain “low impact” telecommunications infrastructure and systems – the notion of what is “low impact” is defined by the relevant legislation.

The Importance of Responding

The relevant legislation requires that an owners corporation receiving a notice from a telecommunications provider under the relevant legislation must respond:

  • in writing;
  • within a certain limited timeframe; and
  • in a specified manner,

otherwise the telecommunications provider may automatically have rights to do certain things pursuant to the relevant legislation.  For example, if the owners corporation fails to properly respond and/or fails to respond within the timeframes governed by the legislation, then the owners corporation may find itself without any basis to argue against a telecommunications provider installing certain equipment and infrastructure on the building, including certain forms of antennas, cabling etc.

“Pushing Back” Against Telecommunications Providers

Over the last 12 months we have seen a rise in the instances of such proposals, and specifically, of inspection notices or installation notices being given to owners corporations.

Normally the manner in which an owners corporation can respond is extremely limited, as is the time in which an owners corporation can respond.

Interestingly, when we have been engaged to object to those notices (in accordance with the relevant parts of the telecommunications legislation) then the telecommunications providers have, almost in every instance, withdrawn their notices and decided not to further engage with that particular owners corporation.

Therefore , even if the situation appears to have been “lost”, where  the owners corporation has failed to take any steps to deal with an inspection notice or installation notice, it is still worth engaging legal advisors to formally object to those notices, as it appears that telecommunications providers may not be willing to take on a “hostile” owners corporation, properly engaged.

Timing is Everything!

Should your owners corporation receive a notice from a telecommunications provider, then it is critical that you seek advice promptly, as some of the timeframes in which the owners corporation is entitled to respond are only 10 days in length.

Under the relevant legislation, any objection must deal with certain specified matters.

Annual Reporting Communication Toolkit

New Bill to Implement Covid Measures Permanently

Did you know that a new Bill Is currently before the NSW Parliament to permanently implement COVID-19 measures for the strata industry?

In the last 24 months, temporary reforms were made to the Strata Schemes Management Act 2015 and the Community Land Management Act 2021 in response to the COVID-19 pandemic.

The COVID-19 and Other Legislation Amendment (Regulatory Reforms) Bill 2022 proposes to make those reforms permanent.

The reforms include:

The reforms include allowing:

    • strata owners corporations, strata committees and community associations, to meet and vote electronically without passing a resolution to do so;
    • owners corporations and community associations to validly execute documents by affixing the common seal electronically or by not affixing the seal at all; and
    • service of a document on an owner or occupier of a lot to be by email to an address nominated by the owner or occupier for the service of documents.

New Annual Reporting Rules for Strata Schemes

On Friday 17 December 2021, the Strata Schemes Management Amendment (Information) Regulation 2021 (the Information Regulation) was published establishing a new annual reporting requirement for strata schemes in NSW.

What does the new annual reporting requirement change mean for NSW strata?

Commencing  June 2022, all NSW owners corporations will be required to:

  • Provide key details about their scheme, including building, safety and management information
  • Help cover the cost of administration and enforcement of the scheme by payment of a lodgement fee of $3 per lot with their annual report
  • Submit their first report within 3 months from 30 June 2022 to 30 September 2022
  • Upload their report online through the Strata Hub

Pets and New Strata By-laws: The Pitfalls

On 25 August 2021, new strata laws commenced which changed the rules regarding pet ownership in strata buildings.

Those rules mark a shift in the NSW Government’s policy concerning pets in strata buildings and encourage pets in strata.
