New Strata Legislation Will Soon Become Law

The Strata Schemes Management Amendment (Sustainability Infrastructure) Bill 2021 is expected to commence in mid-2021.

Overview of New Laws

The key features of the Bill are as follows:

1. An owners corporation will be able to authorise the installation of sustainability infrastructure (such as solar panels) on common property by passing an ordinary resolution.

2. Any decision by an owners corporation that would unreasonably prohibit the keeping of an animal on a lot will have no force or effect.

3. It will be possible for a by-law to prohibit the keeping of an animal (such as a dangerous dog) on a lot if that prohibition is reasonable.

4. An owners corporation will need to keep voting records regarding a secret ballot confidential unless directed to make those records available for inspection by a court or NCAT.

5. NCAT will need to provide a copy of any strata application that is lodged by any person to the owners corporation of the strata scheme concerned.

6. An owners corporation will need to serve a copy of any NCAT application it receives on each owner instead of just placing a copy of the application on the noticeboard.

7. NCAT will have the power to require a person to pay a penalty of up to $5,500.00 for breaching an order made by NCAT.

8. A person who owns more than one lot in a strata scheme will be able to appoint a single proxy in respect of all of the lots (to prevent the limitation on the number of proxies a person can hold stopping this from occurring).

9. A proxy appointment form for a meeting will still be valid even if the meeting is adjourned to a later date.

Conclusion

These new laws will make it easier for owners corporations and owners to install solar panels and implement other “green” initiatives, clarify the validity of “no pets” by-laws and close a loop hole in the strata legislation that prevented NCAT imposing penalties on people who breach orders.

The New Laws that will Impact Strata Industry

On 10 June 2020, the New South Wales Government made new laws regulating the construction of apartment buildings.

Those new building defect laws commenced on 1 September 2020 and will have a significant impact on all owners corporations and the strata industry.

Strata Reforms and Collective Sales

One of the big ticket items introduced as part of the new strata laws that commenced in November 2016 was strata renewal or collective sales. These laws allow a strata building to be sold or redeveloped with the approval of at least 75% of owners.

However, many stakeholders in the strata industry including strata managers have needed clarification and clearer guidance in regards to the strata renewal and collective sale process.

Indeed, the industry has been looking for more practical and specific guidance from regulatory bodies on the implementation of strata renewal reforms.

In late 2018 new guidelines and resources were published by the Office of the Registrar General and can be found on their website.

  2. Initiate the collective sale/renewal process
  3. Form a strata renewal committee
  4. Develop a strata renewal plan
  5. Consider the plan

NCAT Changes the Rules for Strata Disputes

NCAT has recently changed the rules that apply to expert evidence in most strata cases.

These changes relax the rules relating to expert evidence and make it easier for opinions to be given by experts in a quicker and cheaper way.

Previously, if a person such as a building consultant, engineer or valuer, wanted to give expert evidence in a strata dispute in NCAT, they had to comply with certain rules before their evidence would be accepted.

These included rules that required the person to follow an Expert Witness Code of Conduct to ensure that they act as an independent expert and not as the “hired gun” of one of the parties.

Often, an expert’s report would be rejected by NCAT if those rules were not followed.

However, those rules no longer apply to most strata disputes. This means that experts will now be able to give evidence in most strata cases in NCAT without having to comply with every aspect of the Expert Witness Code of Conduct.

This is intended to ensure that opinions for strata disputes, given by experts, are able to be obtained in an easier and cheaper way although those opinions will still need to be soundly based and reliable.

The Right to Legal Representation in NCAT

Did you know a person involved in a strata dispute in NCAT must get permission from NCAT to be represented by a strata lawyer?

Under the previous legislation, legal representation at NCAT was allowed. However, all of that changed with the introduction in 2014 of the NCAT and in 2016 the Strata Schemes Management Act 2015.

This has created problems and questions for many owners corporations which require legal representation in NCAT such as:

  • When and will NCAT grant permission for a party to be represented by a lawyer?
  • What happens if NCAT refuses to allow a strata lawyer to represent an owners corporation – who will present the owners corporation’s case?
  • Can the strata lawyer still help if they cannot provide representation at NCAT?
