To have your say on the proposed building laws reform in NSW you can:

  • Complete the all-in-one survey which allows you to skip through all topics to those that are of interest to you or;
  • If you are only interested in a single topic, you may complete one or more of the 7 individual survey topics
  • You may also make a submission which allows you to give detailed feedback or respond directly to the questions in the regulatory impact statements

New rules for Strata Agents & Residential Property Agents

Updated Rules for Strata and Residential Property Managers

Updated rules for strata managing agents and real estate agents including assistant agents commenced on 1 September 2022.

The laws incorporated feedback from the public consultation in June and July this year on the Property and Stock Agents Regulation 2022.

The new Regulation will keep existing rules plus provide further consumer protection and a reduced administrative load for agents.

There is also a new additional rule that applies to strata managing agents and their assistant agents.

NSW Fair Trading is giving agents a six-month transition period to adjust to the changes from 1 September 2022 to 1 March 2023

What are the New Rules?

Here we explain some changes for strata and residential property managers under the Regulation:

Strata Managing Agents

  • Strata managing agents are now required to cooperate when transferring functions to a strata scheme or community land scheme
  • This applies in situations where the agent’s contract has ended, and the scheme has decided to self-manage.
  • Clarifying the duties of assistant agents performing business agent or on-site residential property manager functions

Residential Property Managers

  • Changing the disclosure of material facts requirements –when dealing with residential tenancy agreements, agents only need to disclose the material facts outlined in the Residential Tenancies Regulation 2019
  • Clarifying the duties of assistant agents performing business agent or on-site residential property manager functions

ABCB Announces NCC 2022! What are the Differences?

The Australian Building Codes Board (ABCB) has announced the following in relation to the recent launch of the National Construction Code (NCC) 2022:

  • As of 1 May 2023, NCC 2022 will be adopted with a transition period until 1 October 2023
  • The transition period is for the modern homes provisions for energy efficiency, condensation mitigation and liveable (accessible) housing
  • While the transition dates from 1 May to 1 October 2023 are in place NCC 2019 will remain in force
  • Following 1 October 2023, NCC 2022 is to be adopted

How Different is NCC 2022?

  • Consistency improvements have been implemented across all volumes with a new structure and number convention
  • It is more web accessible with a significantly improved user experience and reorganised code’s
  • As part of the transition old clause numbers will be listed to the right of documents
  • You will be able to save a PDF version directly to your device or purchase a printed copy of NCC 2022
  • You will no longer need to sign in to NCC Online but you will need to register to ensure you stay up to date with notifications

Strata NSW COVID-19 Laws Extended!

Strata NSW Covid-19 Laws Extended

To help strata and community associations to continue to manage their responsibilities of COVID-19 the NSW Government has extended the timeline for these laws to remain in place.

Laws were previously added to the Strata Schemes Management Regulation 2016 and the Community Land Management Regulation 2021 in response to the NSW COVID-19 outbreak.

These laws included allowing voting at remote meetings to be held electronically by tele or video conferencing, email or other electronic means. It is important to note that these laws will still apply even if a motion has not been passed.

New COVID-19 Strata Law Deadlines

Initially these temporary laws were to end on 31 May 2022 however they will now remain in place until 30 September 2022.

Another “Nail in the Coffin” for Smoking in Strata

Smokers Unknowingly Breaching By-laws

A recent decision of the NSW Civil and Administrative Tribunal (NCAT) has recognised that even though a lot owner smokes inside their lot, they still may be in breach of the by-laws of the owners corporation and  leave themselves open to a penalty being imposed by NCAT.

Why? Because if the smoke leaves their apartment it will almost inevitably penetrate Common Property in one way or another.

This recent case illustrates that it is extraordinarily difficult for smokers to avoid breaching by-laws and why it’s important to have a well-drafted by-law if the owners corporation wishes to comprehensively deal with the issue.

NCAT Tightens the Screws on By-laws!

A recent decision of the Appeal Panel of the NSW Civil & Administrative Tribunal (NCAT) has highlighted the potential risks for owners corporations seeking to impose penalties and other sanctions on lot owners in connection with non-compliance with by-laws.

Careful attention will need to be paid by owners corporations to “cost recovery” aspects of their by-laws to ensure that an otherwise well constructed by-law is not rendered completely invalid.

Owners corporations who have these by-laws should give consideration to having them reviewed.

More than 1.2 million people live in strata schemes across NSW.

The NSW Government wants to introduce new annual reporting to better meet strata communities’ needs and improve consumer protection.

Which means, owners corporations would need to report and verify information each year on the NSW Government’s Strata Hub. This digital portal will centralise strata information, which is currently hard to find or unavailable.

As such, the NSW government has drafted a proposed Strata Schemes Management Amendment (Information) Regulation outlining the information to be reported, who can access it, the costs and the start date.

The NSW government wants to hear from people who live, own, rent, work or planning to invest in strata and councils and other strata stakeholders.

Earlier this year, the NSW government consulted broadly on what people want from a Strata Hub. Once fully implemented, the hub will offer up-to-date strata information, provide key data on how schemes are being managed, and make communication easier.

NCAT Gives Green Light to “User Pays” By-laws

In a recent decision, the Appeal Panel of NCAT has approved of a by-law which introduced a “user pays” system for the cost of electricity used to keep hot water supplied to some but not all lots in a mixed-use strata scheme.

This decision confirms that an owners corporation is able to make a by-law that introduces a “user pays” system for utilities costs such as water, electricity and gas expenses.

Based in Byron Bay this case is an important step in confirming that an owners corporation is able to introduce a “user pays” by-law for the cost of utilities that are supplied to some but not all lots.

JS Mueller & Co Lawyers has drafted many of these types of by-laws which are not uncommon.
